The service is currently in a public beta testing phase. During the beta period:
myphoto.place is intended for personal photo storage and organisation. You agree not to:
We may suspend or terminate your account immediately if you violate the acceptable use policy. For non-payment (after the beta period), we follow a graduated process: notification, service suspension after 14 days, and data deletion after 30 days.
You may cancel your account at any time. Upon cancellation, you have 30 days to export your data (see Data Portability below). After this period, your data will be permanently deleted.
Your data is yours. You can export it at any time using Immich's built-in export functionality, which provides your photos in their original format with all metadata preserved.
After account cancellation, your instance remains accessible for 30 days to allow you to export your library. If you are unable to access your instance (e.g. due to a technical issue), contact us and we will arrange an alternative method to provide your data.
We implement reasonable measures to protect your data, including redundant storage and encrypted off-site backups. However, myphoto.place is not a backup service. You are responsible for maintaining your own copies of important photos.
To the extent permitted by applicable law, we are not liable for data loss due to hardware failure, software defects, or events beyond our reasonable control. This does not affect any non-excludable rights you may have under Australian Consumer Law or EU consumer protection law.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law. This includes non-excludable consumer guarantees under Australian Consumer Law and, for EU consumers, liability for intentional misconduct or gross negligence under EU consumer protection law.
We aim to provide reliable service but do not guarantee specific uptime. The service runs on single-server infrastructure. Planned maintenance will be communicated in advance where possible. We are not liable for downtime or service interruptions.
We do not offer a formal service level agreement (SLA) at this time.
You own your photos. We claim no intellectual property rights over any content you upload to the service. We do not use your content for training, advertising, analytics, or any purpose other than providing the service to you.
myphoto.place is powered by Immich, which is free and open-source software licensed under the GNU Affero General Public License v3.0 (AGPL-3.0).
The Immich source code is available at github.com/immich-app/immich. If we make modifications to Immich, the modified source code will be made available under the same licence.
These terms are governed by the laws of Australia, where the business is registered. Any disputes will be subject to the jurisdiction of the courts of Australia.
Our servers are located in Finland, which means Finnish and EU law (including the GDPR) applies to the processing of your data. For data protection matters, the Finnish Data Protection Ombudsman is the relevant supervisory authority — see our Privacy Policy for details.
If you are a consumer in the European Union, nothing in these terms affects your rights under mandatory EU consumer protection law, including the right to bring proceedings in your country of residence.
To report illegal content or abuse of the service, contact abuse@myphoto.place. We will assess all reports and take appropriate action in accordance with our obligations under the EU Digital Services Act, the Australian Online Safety Act, and other applicable law.
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
